My car was damaged in transit from the BMW garage. Where do I stand legally?

I had sent my car off for its free annual service from BMW. All this was done no problems but when my car arrived back, their driver informed me that the windscreen wipers had broken during his journey. BMW collected the car and are now informing me I have to pay 拢127 to have this fixed. Should i be responsible for having fixed something that wasn't in my possesion at the time? Any help would be greatly appreciated.

Stand your ground.Think that they should pay for it themselves, as the car was under their care at the time. Try and bluff it. Say that if they don't repair it themselves, then all further repairs/services will be done at a different garage - and they will lose more money that way for certain.

It depends what the problem is, and what caused it.



If the wipers were broken by the driver's actions (e.g. he pulled on the wiper arm and it snapped) then it is the garage's responsibility.



If the wipers failed to operate, perhaps because the motor is worn out, then that cannot be the dealer's responsibility, and you will have to pay.
